Scope
ServerReclaim operates a wholesale buyback desk for surplus, excess, used, new-overstock and end-of-life IT hardware. We transact in bulk — lots, racks, pallets and reels — sourced across the United States and Canada. Single consumer units are out of scope. By submitting an asset list or accepting an offer, you agree to these terms for the related transaction.
Offers
Every quote we issue is a firm bulk offer for the lot described in the signed offer document. Offers are valid for fourteen (14) days from the date of issue, unless stated otherwise in writing. An offer is subject to inspection of the lot on pickup. If the quantity, model, configuration or condition of the hardware received does not materially match the asset list the offer was based on, we reserve the right to revise the offer or decline the lot before title transfers.
Title transfer
Title to the hardware transfers from the seller to ServerReclaim on pickup — that is, when the lot is collected and loaded under our logistics arrangements at the seller's site. From that point, ServerReclaim assumes responsibility for the hardware, and the seller warrants that they hold clear title to the goods and have the authority to sell them, free of liens and third-party claims.
Payment
Payment is released per the terms set out in the signed offer. Unless otherwise agreed, settlement is made by wire transfer within one to three (1–3) business days following pickup and inspection. The offer value, method and timing are fixed in the signed offer, which is the controlling document for the transaction.
Data handling
All data-bearing media included in the lot is sanitized to NIST SP 800-88 standards after pickup, before resale or downstream movement. Physical destruction is available on request and is noted in the signed offer where elected. Certificates of erasure are issued for data-bearing media and form part of the transaction record. Where the seller retains responsibility for pre-pickup data wiping, this is stated explicitly in the offer.
Liability
ServerReclaim's total liability under any transaction is limited to the offer value set out in the signed offer. We are not liable for indirect, incidental or consequential damages, or for loss of data remaining on hardware after the seller has been responsible for pre-pickup wiping. Sellers are responsible for removing or securing any data they do not want included in the lot before pickup occurs.
Governing law
These terms and any dispute arising from a ServerReclaim transaction are governed by the laws of the United States, without regard to conflict-of-law principles. Where a transaction is sourced from Canada, local mandatory consumer-protection provisions are preserved to the extent they apply. Any disputes shall be resolved in the courts of competent jurisdiction in the United States, except where local law requires otherwise.
